Terms and Conditions
Effective: 1 January 2026
1.1. These Terms and Conditions ("Terms") govern the operation, administration, and participation in the Eastmatt Loyalty Programme ("Programme") operated by Eastleigh Mattresses limited ("Eastmatt", "the Company", "we", "us", or "our").
1.2. By registering for, accessing, or using the Programme — whether through digital enrolment, USSD, our mobile application, or in-store point of sale — you ("Member", "Customer", or "you") agree to be bound by these Terms and by our Privacy Policy, available at www.eastmatt.com.
2.1. Eligibility: Membership is free and open to individual residents of Kenya aged 18 years and above. Corporate entities, institutions, or non-individual accounts are eligible for membership only when expressly approved in writing by Eastmatt.

3.1. Earning Rate: Members earn 1 Loyalty Point for every KES 100 spent on qualifying purchases at participating Eastmatt branches, or through our mobile and digital platforms.
3.2. Calculation: Points are calculated on the net transaction value (inclusive of applicable taxes, and after any discounts or vouchers have been applied). Purchase amounts below KES 100 will not accrue partial points.
3.3. Excluded Items: Eastmatt reserves the right to exclude certain categories of goods or services from point accrual, including but not limited to financial services, bill payments, gift vouchers, plastic carrier bags, and promotional items restricted by law.
3.4. Identification at Checkout: To earn points on a transaction, Members must present or provide their registered phone number or digital loyalty identifier at the till before the transaction is completed. Points cannot be awarded retroactively for a completed transaction where membership identification was not provided at the time of purchase.
4.1. Redemption Value: Points may be redeemed against eligible in-store or online purchases at a fixed rate of KES 0.50 per Point (for example, 100 Points = KES 50 off your purchase).

4.3. Non-Cash Exchange: Points have no cash value outside of redemption against Eastmatt purchases. Points cannot be withdrawn as cash, exchanged for cash, or transferred to another Member's account.
4.4. Point Validity & Expiration: Loyalty Points are valid for 12 months from the date they are earned. Points not redeemed within this 12-month validity period will automatically expire and be forfeited on a rolling basis — each batch of Points expires 12 months from its own earn date, independently of other Points in your account.
5.1. Opt-in & Consent: By enrolling in the Programme, you consent to receive transactional and operational communications (such as points-balance updates, receipts, and OTPs), as well as direct marketing messages (such as weekly offers, promotional discounts, and anniversary campaigns) via SMS, email, WhatsApp, or push notification.
5.2. Opt-Out Right: You have the right, at any time, to object to your personal data being used for direct marketing — including profiling carried out for that purpose — without affecting your core loyalty membership rights. Under Kenyan data protection law this is an absolute right: once you opt out, Eastmatt will stop using your data for marketing purposes and will not condition this on any fee or further justification.
5.3. Opt-Out Procedure: You may opt out of promotional and marketing communications at any time, free of charge, by any of the following methods:

5.4. Operational notifications that are necessary for administering your account — such as security verification OTPs or material policy updates — will continue to be sent even where you have opted out of marketing communications, as these are not classified as direct marketing.
6.1. Statutory Alignment: Eastmatt processes your personal data in accordance with the Kenya Data Protection Act, 2019 and its subsidiary regulations, including the Data Protection (General) Regulations, 2021.
6.2. Data Controller Role: Eastmatt acts as the Data Controller in respect of personal data collected for the administration of the Programme.

6.5. Third-Party Data Sharing: Eastmatt does not sell your personal data. We may share limited personal data with verified third-party service providers (for example, SMS gateway platforms, IT infrastructure providers, and software vendors) solely to facilitate the operation of the Programme, and only under written data processing agreements that meet the standards required by the DPA.
6.6. Data Retention: Your personal data will be retained for as long as your loyalty account remains active, or as required by applicable record-keeping laws. Where your account has been inactive for more than 12 months, Eastmatt may archive the account and securely purge the associated personal data in line with the DPA.

7.1. Fraud Prevention: Eastmatt reserves the right to suspend, audit, or terminate a member's account without notice where we detect or reasonably suspect:
7.2. Forfeiture: Where an account is terminated for fraud or breach of these Terms, all accumulated Points are immediately forfeited without compensation.
7.3. Member Cancellation: You may cancel your membership at any time by contacting Eastmatt Customer Service. On closure of your account, all unredeemed Points will be cancelled.
8.1. Programme Modification: Eastmatt may modify, adjust, or suspend any aspect of the Programme — including the Point earning rate, redemption value, or participating categories at any given time.
8.2. Programme Termination: Eastmatt may terminate the Programme in its entirety by giving at least 90 days' public notice. Members will have the opportunity to redeem accrued Points during this notice period, after which any unredeemed Points will lapse.
9.1. Limitation of Liability: Eastmatt is not liable for any indirect or consequential loss, operational downtime, SMS delivery failure, or delay caused by telecom network disruption or third-party platform failure beyond our reasonable control.
9.2. Governing Law: These Terms are governed by, and shall be construed and enforced in accordance with, the laws of the Republic of Kenya.
9.3. Dispute Resolution: Any dispute arising out of or in connection with these Terms shall first be resolved through amicable negotiation. Where negotiation fails, the dispute shall be referred to mediation, or determined by the competent courts of Kenya. This clause does not affect your right to lodge a complaint with the ODPC on data protection matters under clause 6.4(g).
